I don't know that this will pass, it is in direct conflict with a bill that passed last year. Basically the legislature doesn't have control over that section of the health and safety code, even though they legally have legislative control over the entire health and safety code(California law is awesome like that). An amendment to the bill from last year and possibly the vehicle code would be needed.
