Those of you who met me and Dan will know him .
I got a call last night at 10:30 that he was in an accident on his CBR1000RR. After I finally got a call today from him he tunred out with only a broken wrist . Now here is the crazy part :

Him and a buddy were riding in town last night . There is a fire station along the road in town . as they get closer his buddy sees the firefighters out front throwing a football back and forth . They must have been bored .

Apparently someone over threw the ball it hit a moving car and bounced back at Dan and he hit it dead on in the front wheel . He was doing about 45mph and it instantly stopped the bike and he was catapulted over the bars . He is scuffed up and now has the broken wrist . He said he saw the bike get tumbling towards him, luckily he got out of the way .

Now for guys that know him I am sure you all know what he did next . Got up and proceeded to try to kick some ass.

That was haulted as they quickly took him the hospital . The fire chief was real pissed at what happened and he said they were told to throw ball behind the fire house .

Lets all hope he is back to work soon, we almost got the engine in the 67 fastback yesterday and was planning on finishing that up today

 What a story..What are the chances? Thank God the broken wrist is the only thing that happened to him. Something tells me he will be riding a new bike and then some on the city after everything is said and done!!

I think he is done with bikes, this is the second time . last time a girl on spring break turnned across 3 lanes of traffic to make a right tun and hit him as he was going through . she said" I cant belive you ruined my weekend" She deserved a little bitch slap for that comment. They actually replaced the whole frame of the bike and did not total it .

The doctor saod he broke the hardest bone in your body to heal !

I am sure there will be some sort of lawsuit. Maybe he will buy Fuel off of me , LOL !!!

Why? we live in a litigious society. While I chalk it to "accidents happen" they should be liable for the injury caused by their actions. I don't see anyone saying he should sue for a million bucks, but to get the damages, medical, lost wages and a bit for the good old Pain & Suffering isn't out of line.

After all, this isn't like the lady that spilt hot coffee on herself.. Dan did nothing to contribute to the accident (besides ride a bike).

Sorry to hear about that! Glad he is okay.

I am with Charley on lawsuits. I understand getting medical and damages paid for, lost wages ect. That is without a doubt deserved. I think its just we see all these crazy lawsuits these days with enormous settlements that you got to feel for the people on the other end who may have just made a mistake.

Thank God your buddie's OK. He'll get his bike, lost wages, medical, etc. However, sueing a municipality is nearly impossible. Most lawyers will run from those type lawsuits. Nature of the beast unfortunately. Not a lawyer but I know more than the average bear. Good luck to your friend.

I am sure he will get things taken care of but I agree on the sueing of a municipality.

Thanks for your concerns

Just because we live in a litigious society doesn't make it right. I'm sure the public entity will cover the costs without being sued. Yes it sucks that the football was thrown in the street but this is not like some uninsured crackhead rearending your car. These were firemen throwing a football..

I had the pleasure of meeting Dan on the PT at E-Town, awsome dude indeed! It really could have been worse. The very reason I don't own a bike, its always the other guy, girl, football?

I hope he gets better soon

PS Jason, If your thinking of unloading FUEL, I have a vert for you in your favorite color!!! ;) http://i6.tinypic.com/1zb3qj9.jpg

See, your confusing a "enormous settlement (ie crazy)" with a reasonable settlement. If he sued for one million bucks that would be sad.. sueing for $10k or so for the hassle and pain is another matter.

And that's why the fire dept has insurance.. for when they make "mistakes".

But maybe they might just step up and do whats right. One should always ask before getting the scum lawyers involved.

The 10K will turn into 100k when you factor the lawyers cut into it.

Hey Jason,
Tell Dan I wish him a speedy recovery....
I am glad it was not any worse.
He needs to give up bikes.
Tell him to sell his bike and finish up his 85 GT..
That should give him enough adraneline rushes to keep him happy
Oh and I can only imagine Dan getting ready to open up a can of whup ass.

He should wait and ask the city to compensate him for his medical bills, wages lost from missed work, etc. If the city has their heart in the right place they would do this without having to be asked. If it should happen that the city refuses to offer any kind of compensation, then you should get a lawyer involved and a lawsuit should follow.

Me too .. My wifes attorney here and i have heard lots of "horror storys" how people are suing like hell just trying to make money with someones pure mistake.. Cmon, they were just having fun with ball and made a mistake. I really dont think they were trying to hit the biker...

No one is saying that the Fire Department should be "punished" for what they did. If they guy fell and scraped his knee but was otherwise fine...I would let it go. But if the guy breaks a bone and has to miss work, or his bike is messed up and he's looking at a $350 or $500 deductable to fix it...somebody should fork over some money. That's all we're saying. The only time you take legal action is if the city were to refuse to do anything in just such a case. We're not talking about a huge amount of money here or a windfall of cash in the hundreds of thousands for pain and suffering. Just compensation...that's all.

Well at this point he went for a surgey consulation and ended coming home with both wrist in a cast . He is going to be out for awhile. It is definately going to hurt his pocket. The bike is messed up pretty bad also. No work , No pay , No bike , truck , house, electric, FOOD, he has 2 small kids!

I just hope noone screws him around. He is not looking to get rich or anything but He was already told that his movement in his one wrist will never be the same. That there very well could prohibit lots of things for his future. That would be the kicker there that would upset me! That would need compensation!

I also might add that the fire chief has come out and amitted that the guys were told to not be out front playing football, Many times! Its not like these guys are 10yr olds you know!

Oh man, I am glad he is home, but with two casts!!! You are right, he is going to be out for a while!!! I am sorry to hear that.

I agree, I was making the comment about those huge settlements, and I do agree that he totally deserves just compensation for what was lost, and it seems like there is going to be alot lost, which I am truly sorry for. I was making the comment in general about what sadly alot of our big judicial system cases have become.

Once again, best wishes to your friend and his family!
