that sucks big time id move.kentucky i drive my big block truck around with a set of purple horines in the headers thats my exhaust and no one cares its great.

I used to live in Fitchburg many moons ago. :D And it is a crappy little town that is poor which used to be rich. The tax base is steadily going away. Tickets like yours are their lifeblood. I say make them put your exhaust on a sound meter. Let them work for the money.

He didn't say anything about sound, he just said that it was modified, he said that anything besides stock is illegal, I said that it passed inspection, he said that didn't matter.
yeah i would fight it at least make your congresman hear your dislike with that stupid law.
here in connecticut they are pretty leinient but are starting to crack down on those loud ass Harley bikes.
Oh last show in pittsfield i too got pulled over and he gave me a warning .
(i got connecticut plates)

if it passed inspection like that id try to fight it.they cant pull that dot crap the car was built before that.i had a cop give me a ticket for no seat belt in a 65 impala when my states law says 1980 and newer you have to wear one. i had to fight that ticket in court judge laughed at the cop but did want to see my car.

thats lets jut say BS. Define modified exaust. I would show up to court on this one. I got a speeding ticket for 66 in a 55 at 3:00am not traffic and cruise set a 59. I am going to fight it. In general most cops are pretty level headed. A Cop wasting you time on modified exhaust is stupid and a waste of time. The Courts, cities and counties are looking for $$$. My opinion has been I will pay the county or state an extra $350 a year just to leave me alone. This country is becoming a Police State and we all need to stand up to this kind of behavior. Sorry bout your situation. Actually that ticket borders harassment.... :thumbsup:

Except our congressmen are against us. They are the ones that are responsible, the police are just doing their job. Though some are less likely to let a minor violation slide.
The officer that stopped him is probably one of the few that'll actually give someone a hard time by doing what the city/town/state are asking them to do. I know a lot of guys in law enforcement and most are car guys and Harley riders, they wouldn't even bother unless the driver was doing something else that would warrant a stop.
Still, that really sucks Dave.

As far as I know a written warning goes into the system but it think it's more of a probationary thing, sorta like getting caught speeding after a long period of time without a citation. The next time you get pulled over for it though, you'll have to pay or appeal.
Personally, I wouldn't waste your time. As long as your careful not to nail it around any patrol cars, they probably won't notice. I'll try to find out for you if I can.
I wouldnt screw with them....My boss's son is studying to be a lawyer...he told my boss the government always wins....your car probably is loud...i'd say screw it...but thats just me

It's a warning with no fine.....As for being in the system, I wouldn't worry about being profiled as a habitual loud/non stock/modified exhaust offender. Cops have more important things to worry about and so do you. Life is too short, move on.

Dave- Get in touch with SEMA (call Jason Tolleson 202-783-0865) and let him know about this. We are fighting hard against an impending bill here in MA to stop crap like this so they can give a clearly defined db level.
Was this given by a cop? If so, chapter 90 does NOT have a db level on it- and it is left to the subjectivity of the cop ('it sounds loud' know what I mean?)
The Massachusetts Assoc of Auto Clubs is (www.massautoclubs.org (http://www.massautoclubs.org) )also holding a meeting Wed at the Endicott Estate in Dedham at 7pm- (10/24/07) - and they also have been working on fighting legislation like this-
maybe you should attend or contact SEMA and find ways to fight this crap as it isnt right.

There are a lot of states that have "modified/louder than stock statues. It is not hard for a police officer to testify to that based on his training and experience. I am sure any of us car guys can tell a car that drives past with "non stock" exhaust. There are a lot of junk vehicles on the road that have loud offensive exhaust. The 90 db rating that SEMA has lobbied for in many states is a move in the right direction since it removes the subjectivity. The challenge is that few agencies have the tools to measure the db rating preventing enforcement of those that need to be cited.
As far as "Courts, cities and counties are looking for $$$" I have never in 25 years as a police officer written an infraction for the purpose of generating revenue. If elected officials told police to write tickets the majority of officers would refuse.

I realize that there are officers who can be out of line (I am sure people have thought that about me.) but if the statute reads "louder than stock" my guess is it probably is. After all none of us would want a stock exhaust note on our performance machines.
As for fighting a warning - I am not sure there is a need. All states and departments are differant, but I have never seen a driving record that shows "warnings." Many agencies do keep the information in their local records.
